1. Acceptance of these terms

By accessing or using sonardevelopment.com (the "site") or by submitting an enquiry or project brief through it, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the site.

These terms are operated by Sonar Development ("Sonar Development", "we", "us" or "our"). You can reach us at any time at .

If you are using the site on behalf of an organisation, you confirm that you have authority to accept these terms on that organisation's behalf.

2. The site and what it offers

The site is a marketing and information website for Sonar Development, a design and development studio. It describes our services, presents examples of our work, and lets prospective clients contact us.

The site provides two enquiry mechanisms: a contact form and a more detailed project brief form. These let you tell us about an enquiry or a potential project so that we can respond.

The site is not an account-based product, a marketplace, or a transactional service for the general public. It does not let you create a public user account, purchase a product online, or complete a paid transaction. Any engagement of our services is arranged separately and in writing, as described in section 6.

We may change, suspend, or withdraw any part of the site at any time without notice. We do not guarantee that the site, or any part of it, will always be available or uninterrupted.

3. Enquiries and brief submissions

When you use the contact form or the brief form, you provide information so that we can understand and respond to your enquiry. We handle that information as described in our Privacy Policy.

You agree that the information you submit is accurate to the best of your knowledge, that you are entitled to share it, and that it does not infringe anyone else's rights. Please do not submit other people's personal data through the forms unless you have a proper basis to do so.

Free-text fields (such as your message, project objective, and supporting details) should contain only the information needed for your enquiry. Please do not submit sensitive personal information, confidential third-party material, or unlawful content through these fields.

Submitting an enquiry or brief does not create any contract or engagement between us, and does not oblige us to provide any services. It is an invitation for us to respond. See section 6 for how engagements are formed.

4. Acceptable use

You agree to use the site lawfully and only for its intended purpose. In particular, you agree that you will not:

  • use the site or its forms in any way that breaches any applicable law or regulation;
  • submit content that is unlawful, defamatory, abusive, misleading, or that infringes the rights of others;
  • attempt to gain unauthorised access to the site, its servers, the admin area, or any connected systems or data;
  • use any automated means, bots, or scripts to submit forms, scrape content, or place unreasonable load on the site;
  • attempt to bypass, probe, or interfere with the site's security, rate-limiting, or anti-abuse measures;
  • introduce any malware, or otherwise attempt to damage, disrupt, or impair the site or its infrastructure; or
  • use the enquiry forms to send spam, solicitations, or content unrelated to a genuine enquiry.

5. Intellectual property

The site and its contents - including the text, layout, branding, graphics, the Sonar name and logo, and the original design concepts and project examples shown in our Work - are owned by Sonar Development or its licensors, and are protected by intellectual property laws.

You may view the site and print or download extracts for your own personal, non-commercial reference. You must not otherwise copy, reproduce, republish, distribute, or commercially exploit any part of the site without our prior written permission.

Project examples and case material shown on the site may include the brands, trade marks, or content of our clients; those remain the property of their respective owners and are shown for illustrative purposes.

Ownership of any deliverables we produce for a client under a separate engagement is governed by that engagement's written agreement, not by these terms.

6. Engagements are governed by a separate agreement

Nothing on the site, and no enquiry or brief you submit, constitutes an offer or a binding agreement to provide services. Descriptions of our services on the site are for general information and may change.

If we agree to work together, the engagement will be set out in a separate written agreement (for example a proposal, statement of work, or contract) signed or accepted by both parties. That agreement - not these terms - will govern the scope, fees, timelines, deliverables, ownership, and any service commitments for the work.

Where there is a conflict between these terms and a signed engagement agreement, the engagement agreement takes precedence for that engagement.

7. No warranties

The site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no representations or warranties of any kind, whether express or implied, about the site or its content - including any implied warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement.

The content on the site is for general information only. It does not constitute advice and should not be relied upon as such. While we take care to keep the site accurate and up to date, we do not warrant that it is free of errors or omissions, or that it will be available, secure, or free of harmful components.

8. Limitation of liability

Nothing in these terms excludes or limits our liability where it would be unlawful to do so - including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Subject to that, and to the fullest extent permitted by law, we will not be liable for any loss of profit, loss of business, loss of goodwill, or any indirect or consequential loss arising out of or in connection with your use of, or inability to use, the site.

The site is provided free of charge, for information only. Subject to the first paragraph of this section, if you are dissatisfied with the site or its content, your sole and exclusive remedy is to stop using it.

This section governs use of the site only. Liability for any paid engagement is dealt with separately in the relevant engagement agreement.

9. Third-party links and services

The site may contain links to third-party websites or resources, and our service depends on third-party providers (for example, hosting, email delivery, and anti-abuse verification). Those third parties are not under our control.

We are not responsible for the content, availability, or practices of third-party websites or services, and providing a link does not imply our endorsement. Your use of any third-party site or service is at your own risk and subject to that third party's own terms.

10. Privacy and data protection

Our handling of personal data submitted through the site is described in our Privacy Policy, which forms part of these terms. We process personal data in accordance with the UK GDPR and the Data Protection Act 2018.

11. Changes to these terms

We may update these terms from time to time to reflect changes to the site, our practices, or the law. When we do, we will revise the "Last updated" date at the top of this page.

12. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or your use of the site (including non-contractual disputes or claims), are governed by the laws of England and Wales.

The courts of England and Wales will have exclusive jurisdiction to settle any such dispute or claim, subject to any non-waivable rights you may have as a consumer under the law of your place of residence.
